The Process*

  1. File form I-589, Application for Asylum and for Withholding of Removal;

  2. Wait for interview date with an asylum officer;

  3. If not approved at interview and you are out of status, the case will be referred to the Immigration Court;

  4. If not approved at interview and you are in status, no further action will be taken;

  5. If approved at the interview, may apply for adjustment of status for permanent residence one year after the approval.
